Fillmore County District Court Jurisdiction

The official Fillmore County District Court page states that the court has original jurisdiction in all civil, family, probate, juvenile, criminal, and traffic cases filed in Fillmore County. That makes District Court the local trial-court venue for the site's major record categories. Probate is a division of District Court. Divorce is a family case in District Court. Traffic citations, criminal charges, civil suits, and juvenile matters also route through District Court when filed as court cases.

Fillmore County does not have a separate county court, justice court, JP court, municipal court, or stand-alone probate court for local court-case jurisdiction in the research map. Preston and other cities may have law-enforcement contacts or prosecution contacts, but those contacts are not separate courts for court records. Once a case is filed, the District Court and Court Administration are the record path.

Fillmore County District Court Table

The required court table is short because Fillmore County has one District Court venue in the research. The table also includes the local court administration function, jury line, payment center, and closely related justice-system offices that appear in the court hierarchy inventory. These are not separate trial courts, but they are common routing points for case access, payments, prosecution, defense, probation, and jail issues.

District Court vs Lower Courts

The state court structure map for this project found no separate lower court for Fillmore court-case jurisdiction. That means the comparison is less about choosing among county, justice, and municipal courts and more about knowing which non-court office holds a related record. Court case files stay with District Court. Sheriff records, county data requests, and recorder or Auditor-Treasurer records follow different office routes.

Third Judicial District

Fillmore County is in Minnesota's Third Judicial District. The district includes Dodge, Fillmore, Freeborn, Houston, Mower, Olmsted, Rice, Steele, Wabasha, Waseca, and Winona counties. The district page says 24 judges and one referee serve the district. The listed chief judge is Hon. Christine A. Long of Rice County, the assistant chief judge is Hon. Christa M. Daily of Olmsted County, and the Judicial District Administrator is Shelley Ellefson.

The Third Judicial District is an administrative structure, not a separate appellate court. Fillmore County case filings still occur in local District Court. Districtwide quick links may include administrative orders, policies, Early Neutral Evaluation, calendar links, and district administration resources. A Fillmore family, civil, criminal, probate, or traffic record remains a Fillmore District Court record even when a district policy or district-level resource applies.

Fillmore County Courthouse Details

The primary courthouse is the Fillmore County Courthouse, 101 Fillmore Street E., Preston, MN 55965. The official court page lists Court Administration at (507) 765-6021, fax (507) 765-5228, Court Administrator Jordan Marcou, and business hours Monday through Friday, 8:00 a.m. to 4:30 p.m. Public parking is available in the lot on the east side of the courthouse and on the street.

The official county history says the county seat moved from Chatfield to Carimona and then to Preston. Preston citizens decided to build a brick courthouse on February 24, 1863, two wings were added in 1884, and the present courthouse was erected in 1958. A county office building was completed March 17, 2000. After September 11, 2001, the county completed a courthouse addition, remodel, and mechanical upgrade in February 2005, adding 16,320 square feet.

Federal Court Distinctions

Fillmore County is within the U.S. District Court for the District of Minnesota, but there is no federal courthouse in Fillmore County. Federal court handles federal criminal prosecutions, federal civil-rights and constitutional claims, federal-question civil cases, diversity cases, federal habeas matters, and other federal jurisdiction cases. Bankruptcy is handled by the U.S. Bankruptcy Court for the District of Minnesota, not by Fillmore County District Court.

Federal records are accessed through PACER or federal court clerk routes. Appeals from the District of Minnesota go to the U.S. Court of Appeals for the Eighth Circuit. These systems are separate from MCRO and Fillmore Court Administration, even when the person or event also has a state court record.

Appeals Fees and Higher Courts

State appeals from District Court generally move to the Minnesota Court of Appeals, which the Judicial Branch describes as the intermediate error-correcting court. The Minnesota Supreme Court is the court of last resort for state-law matters. A Fillmore County criminal sentence, civil judgment, divorce order, probate order, or traffic conviction begins in District Court and may later have appellate records if appealed.

Federal appeals follow a different route. The District of Minnesota's records and fee pages cover federal copy and fee issues, and federal appeals go to the Eighth Circuit.
